NO SOLUTION FOR DANAS?

Belgrade, January 9, 2012 (Danas) - For eight months now, the daily Danas has failed to collect its recompensation from Kurir and Glas Javnosti.

The recompensation, to be paid by dailies Kurir and Glas Javnosti, after Danas had paid the damages of 942.000 RSD for solidary responsibility for articles published in these three dailies, has not been paid yet since their accounts were blocked. The problem also lies in the transfer of ownership rights of the daily Kurir, hence it is unclear who the daily Danas needs to get recompensated from, namely which legal entity is obliged to refund the part of the damages to Danas, as it had paid the entire amount of damages in the name of all three dailies.

To remind, three policemen from Pozarevac had suffered injuries to their name and reputation by articles of Dusanka Novakovic from Pozarevac, initially published in dailies Kurir and Glas Javnosti on October 30, 2006, and then in Danas three days later. According to the effective decision of the First Basic Court in Belgrade at the proposal of the Prosecution, daily Danas was obliged to pay compensation of 200.000 dinars for all three parties sued, as well as court costs of 138.500 dinars with interest. Daily Danas would later seek recompensation from other dailies sued in the process.

Expert for media law Slobodan Kremenjak explains that the problem had appeared in the procedure when the decision needed to be objected as not deriving from the law, but he also says that it is now difficult to recompensate part of the damages.
