SBB NOT FINED FOR ABUSE OF DOMINANT POSITION

Belgrade, February 14, 2013 (Blic) - The Supreme Cassation Court has dismissed the claim of the Serbian Cable Network (SBB) to have the decision of the Administrative Court reviewed.

According to the Commission for protection of the competition and conveyed by the Beta news agency, the Administrative Court has decided that the cable operator had abused its dominant position in the Belgrade market.

The decision of the Administrative Court has been made on the basis of the claim against the decision of the commission in the renewed proceedings, passed back in October 2010.

The Commission had issued a decision on SBB having dominant position in the market of providing services of distribution of radio and TV programs via cable network on the territory of Belgrade and abusing such position by leading promotional campaign on the territory of Belgrade municipalities Palilula and Stari grad during March 2006. The commission found that SBB had obstructed, limited and injured competition in the above relevant market.

SBB was not fined for the abuse of monopoly position in Belgrade, according to the Beta news agency, as the pecuniary penalty was not stipulated by relevant regulations. The Commission will, however, not be able to fine SBB because of the obsolence of the case, Tanjug reported.
